Any product that is in a defective state or condition and if it’s unreasonably unsafe to the consumer who buys or uses it, and it causes physical harm. This is considered a defective product and should not have been sold. There are a few different types of product defects. You have design defects, manufacturing defects, and marketing defects.
Design defects are when there is a error that happens during the creating or design of the flawed item that affects the whole product line. Manufacturing defects are caused by an error that happens during the putting together of the product and that was not intended to be apart of the product. Marketing defects are when the builder or seller of the product does not caution the consumer about any dangerous components of the product. Since there are so many products and medications in the united states, pharmaceutical and product defects are things that happen a lot.
Pharmaceutical defect is where there is a defect in the development of creating, manufacturing or even the marketing of a prescription drug and whoever is taking the medicine gets hurt, because of the defect. If this were to happen a pharmaceutical lawsuit could take place. Product defect is where the product that was purchased is not reasonably safe to use and it causes an injury to the consumer. If this were to happen then a product lawsuit could take place.
